Breastfeeding
Breastfeeding in Washington, DC is supported by a combination of local laws, federal protections, and public health programs designed to ensure that parents can breastfeed safely and comfortably—at home, in public, and at work.
Legal Protections for Breastfeeding
Right to Breastfeed in Public
Washington, DC law protects a parent’s right to breastfeed in public and private spaces.
Breastfeeding and lactation are protected under the DC Human Rights Act, meaning it is unlawful to discriminate against a person for breastfeeding in any place where they are otherwise allowed to be.
Breastfeeding is considered a protected condition related to sex and pregnancy under DC law, and individuals may nurse or express milk in public or private locations where they are legally present.
Jury Duty Exemptions
Washington, DC does not automatically exempt breastfeeding parents from jury duty. However, nursing parents may request a deferral or postponement due to breastfeeding or childcare needs, and accommodation by contacting the DC Superior Court Jury Administration Division.
Workplace Protections for Breastfeeding
Break Time and Private Space
Under the federal Fair Labor Standards Act (FLSA) and the PUMP for Nursing Mothers Act (2022), most nursing employees in DC are entitled to a reasonable break time to express breast milk for up to one year after and a child’s birth private space (not a bathroom) that is shielded from view and free from intrusion.
Additional DC Workplace Protections
Washington, DC law goes further by requiring employers to make reasonable efforts to provide a sanitary, private lactation space, allow flexible break times for expressing milk, and protect employees from retaliation for requesting lactation accommodations.
These protections apply to most DC employers and complement federal law.
